Terms of Service
Draft, to be reviewed by counsel. This is a starter document and is not yet final legal advice or a binding version of our terms.
Last updated 29 September 2026
These terms govern your use of silentugc (the “Service”), operated by silentugc (“we”, “us”). By creating an account or using the Service you agree to them. If you use the Service for a company, you confirm you can bind that company, and “you” means the company.
1. The Service
silentugc generates short-form video ads. You give us your app's URL and other inputs; we produce a brand brief, hook copy, AI creator footage and rendered videos. Features may change as the product develops.
2. Accounts and workspaces
- You must be at least 18 and give accurate account information.
- You are responsible for activity in your workspace and for the people you invite to it.
- Keep your sign-in email secure. Tell us promptly at hello@silentugc.com if you suspect unauthorised access.
3. AI-generated content
The Service uses artificial intelligence to create text, images and video (“Output”). You understand and agree that:
- The creators that appear in Output are synthetic, AI-generated people. They are fictional and do not depict, and are not intended to resemble, any real person.
- Output may be inaccurate, unexpected or similar to content generated for other users. Review every video and its claims before you publish it. You are responsible for the claims your ads make about your product.
- AI-content labelling is your responsibility. Advertising and social platforms (including TikTok, Meta and YouTube) have their own rules for disclosing AI-generated or synthetic media. When you publish or run Output, you must follow those rules, including switching on any required AI-generated content label or disclosure.
4. Acceptable use
You must not use the Service to:
- create a creator, portrait or video that depicts, imitates or is meant to resemble a real, identifiable person, including celebrities, public figures, private individuals, and you or your staff;
- depict minors, or describe a custom creator as under 18;
- make deceptive claims, fake testimonials or endorsements, or present an AI creator as a real customer of your product;
- advertise anything unlawful or anything the relevant ad platform prohibits, or create sexual, hateful, harassing, violent or otherwise harmful content;
- infringe anyone's intellectual property, privacy or publicity rights;
- reverse engineer, scrape, overload or resell the Service, share accounts to avoid plan limits, or get around rate limits or credit charges.
We may refuse, remove or stop generating content, and suspend accounts, that we reasonably believe break these rules.
5. References
You can submit links to existing videos (“References”) as examples of a format. We analyse a Reference to describe its structure: camera framing, setting, performance, pacing and hook pattern. We do not copy, host for redistribution, or include the original video, its audio or its creator in your Output. Analyses may be cached and reused across workspaces. Only submit publicly available links, and do not use the Service to recreate a specific creator's identity or protected content.
6. Your content and Output
- Your inputs. You keep ownership of what you upload or provide (your URL, logo, app screenshots, uploaded clips). You grant us a licence to use them only to provide and improve the Service for you. You confirm you have the rights to them.
- Output. As between you and us, and subject to these terms and third-party licences, we assign to you any rights we hold in Output generated for your workspace, and you may use it in your own advertising and marketing. Because Output is AI-generated, copyright protection may be limited and we don't guarantee it is unique.
- Music and stock footage. Optional music and stock clips come from Mixkit and are used under the Mixkit licence. Your use of them in Output must follow that licence.
7. Credits, plans and billing
- The Service is metered in credits. Current plans, credit allowances and per-action costs are on the pricing page. We show the credit cost before a render starts.
- New workspaces receive a one-time trial grant of free credits. Trial credits have no cash value.
- Paid plans are monthly subscriptions billed in advance through Stripe and renew automatically until cancelled. Plan credits are granted each billing period and do not roll over.
- Top-ups (100 credits for $45) are available on paid plans and do not expire while your account is open.
- If a render or generation fails, the credits it used are refunded to your balance automatically.
- Except where required by law or stated here, payments are non-refundable and unused credits are not redeemable for cash. We may change prices with at least 30 days' notice before your next renewal.
8. Cancellation and termination
You can cancel at any time from the billing page. Cancellation takes effect at the end of the current paid period, and you keep access until then. We may suspend or end your access if you materially breach these terms or fail to pay. On termination we delete your workspace data as described in our Privacy Policy.
9. Third-party services
The Service relies on third-party providers (for example AI model providers, hosting and payments). Their availability is outside our control. Ad platforms may reject or restrict ads for their own reasons; we don't guarantee that any ad will be approved or perform.
10. Disclaimers and liability
The Service and Output are provided “as is”, without warranties of any kind to the extent permitted by law. To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, lost profits or ad spend, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
11. Indemnity
You will defend and indemnify us against third-party claims arising from your inputs, your published ads, or your breach of these terms, including failure to label AI-generated content as required.
12. Changes and contact
We may update these terms; we'll notify you of material changes by email or in the product. Continued use after changes take effect means you accept them. Governing law: [to be confirmed]. Questions: hello@silentugc.com.
